User Agreement

Welcome to Populer.com (“Populer,” “we,” “us,” or “our”). This User Agreement (“Agreement”) governs your access to and use of Populer.com’s websites, applications, APIs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to comply with and be bound by this Agreement and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Account Registration

  • 1.1 Age Requirement: You must be at least 13 years old or the age of majority in your jurisdiction to create an account and use the Services. Minors are prohibited unless authorized by law.
  • 1.2 Account Information: You agree to provide accurate, complete, and current information during registration and update it if it changes.

  • 2.3 License: You grant Populer a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and display your content to operate and promote the Services.
  • 2.4 Warranties: You represent that you own or have rights to the content you post and that it does not violate laws or third-party rights.
  • 2.5 Prohibited Content: You agree not to post content that is unlawful, fraudulent, defamatory, obscene, hateful, infringing, or harmful.
  • 2.6 Content Removal: Populer may remove or restrict access to content that violates this Agreement.
  • 2.7 Responsibility: You are solely responsible for your content and its consequences.

3. Platform Features and Interactions

  • 3.1 Services: Populer provides features such as profile creation, posting, commenting, messaging, verified accounts, and AI-driven recommendations.
  • 3.2 Interactions: Users must act respectfully and refrain from harassment or hate speech.
  • 3.3 Monetization: Populer does not currently support payments between users.
  • 3.4 Verified Accounts: Misuse of verification may result in revocation.

4. Acceptable Use and Prohibited Conduct

  • Use the Services lawfully and ethically.
  • Do not impersonate others or misrepresent yourself.
  • Do not transmit spam, malware, or unauthorized ads.
  • Do not interfere with servers or security features.
  • Do not scrape data or use bots without permission.
  • Report violations responsibly.

5. Artificial Intelligence and Automated Systems

Populer uses AI and machine learning to personalize content, moderate activity, and detect security threats. These systems analyze behavioral data to enhance user experience. AI results may not be perfect; users can adjust preferences or opt out in settings.

6. Advertising, Tracking, and Analytics

Populer displays personalized ads using cookies and analytics tools. Third-party advertisers (e.g., Google, Meta, TikTok) may access pseudonymized data for ad targeting. You may opt out of tracking through settings or device options.

7. Privacy and Data Protection

Your personal data is governed by our Privacy Policy. By using Populer, you consent to international data transfers and agree to our data practices. You have rights to access, correct, delete, and restrict processing of your data.

8. Third-Party Content and External Links

The Services may include third-party links for convenience. Populer is not responsible for the content, safety, or accuracy of external sites. Your interactions with third parties are at your own risk.

9. Security and Data Breach

We use industry-standard measures to protect your data. If a breach occurs, we will notify affected users promptly and take corrective action. You are responsible for keeping your credentials secure.

10. Suspension and Termination

Populer may suspend or terminate accounts for violations or misuse. Upon termination, your right to access the Services ends immediately, but certain sections of this Agreement (e.g., liability, indemnity) remain effective.

11. Disclaimers and Limitation of Liability

The Services are provided “as is” without warranties. Populer disclaims all liability for damages arising from your use or inability to use the Services. You use Populer at your own risk.

12. Indemnification

You agree to indemnify and hold harmless Populer, its affiliates, and employees from any claims, damages, or losses arising from your breach, content, or misuse of the Services.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Malaysia. Any disputes shall be resolved through arbitration or the Malaysian courts. You waive the right to participate in class actions.

14. Changes to This Agreement

Populer may update this Agreement periodically. We will notify users of major updates via email or platform notice. Continued use after changes implies acceptance.

15. Miscellaneous

  • Entire Agreement: This Agreement and the Privacy Policy constitute the full agreement between you and Populer.
  • Severability: If any term is invalid, the rest remain enforceable.
  • Waiver: Failure to enforce rights does not waive them.
  • Assignment: You may not assign your rights without our consent.
