Understanding AB 1033: How ADU Condo Conversions Are Changing the Bay Area

Most people building an ADU today are not thinking about AB 1033. They should be.

City of Alameda's Planning Board just backed ADU condo conversions, joining a growing list of Bay Area cities allowing homeowners to sell their ADU as standalone property.

Apex Homes completed California's first ADU condo conversion in San Jose, in partnership with the city and Mayor Matt Mahan.

We've been working in this framework longer than almost anyone in the Bay Area. We clearly know why this matters.

The Planning Board recognized what that means: if ADUs are going to carry the city's housing load, they need to be as financially flexible as possible for the homeowners building them.

AB 1033 does exactly that. It allows a properly permitted detached ADU to be converted into a standalone condominium and sold independently from the primary residence.

That transforms an ADU from a rental asset into a sellable real estate unit, creating a new entry point for first-time buyers and a new exit option for homeowners who are built for family but want to capture the investment later.
